Terms and Conditions
A: GENERAL TERMS CONDITIONS:
These booking terms and conditions shall apply to any booking made with AFRIKAKUKAYE Tours and Safaris hereinafter referred to “tour operator” of the one part and “client” of the other part.
B: PAYMENTS TERMS:
i. The client who undertakes to make expedition with tour operator shall fully contact with tour operator, confirm
details and costs thereof.
ii. The accepted payment currency shall be US dollars or its equivalent in a freely convertible currency.
iii. Visa/MasterCard may be accepted.
iv. Payments shall be made by time and dates specified.
v. Booking will be confirmed and secure after 30% deposit of the whole sum and the difference thereof be effected within 45 days prior to departure
vi. The 30% deposit shall not be refunded to the client in case the balance due is not paid within 45 days. The person signing the booking form accepts responsibility for payment for all the persons on the booking, and is responsible for informing all party members of the relevant booking details.
vii. If the booking is made within 45 days of the departure then full payment is required to confirm the booking.
C: TRANSPORTATION/LIABILITY/INSURANCE:
i. The tour operator’s vehicle fleet are comprehensively insured per Tanzania insurance laws and regulations.
ii. All transportation insurance in Tanzania covers passenger vehicle only. Clients therefore are advised to have personal travel insurance in place prior to departure.
iii. The tour operator‘s vehicle fleet meet all safety requirements and are fully equipped with first-aid kits and emergency supplies
iv. The tour operator will exercise utmost care in handling its clients and their property, but will not be responsible for loss or damage to personal belongings or personal injury. Clients are therefore advised to obtain relevant insurance and that all activities are undertaken at the clients own risk.
v. The tour operator shall not be held responsible in the rare event an animal or other environmental factor causes injury to clients whilst in the bush. While every precaution will be made to avoid hazards, the tour operator insists you follow the safety instructions from your driver/guide and the procedures and guidelines of your locations.
vi. The tour operator shall take all necessary actions to minimize chances for accidents whilst on the roads
D: EXECUTION OF THE CONTRACT
i. The tour operator reserves the right to make minor changes of travel arrangements at any time upon communication to such changes to the client at earliest possible time.
ii. The tour operator may cancel client’s journey arrangements including itinerary, accommodation or arrangements where necessary for the purpose of improving service and meet the highest degree of client’s expectation.
iii. The right is also reserved to decline to accept or retain any person as a member of any tour at any time; in any case a reasonable refund may be paid.
iv. The tour operator, after confirming issued invoice, shall assist the client to make necessary changes such as accommodation or departure dates.
v. Any request for changes to be made shall be in writing or reduced into writing by the client to the tour operator.
vi. The client may be asked to pay an administration nominal charge and any further cost the tour operator may incur for such alteration.
E: CANCELLATION AND REFUND POLICY:
i. That tour operator shall immediately arrange for safari and other facilities upon signing of the contract as per agreement with the client.
ii. No refunds shall be affected for lost travel time or substitution of facilities, for itineraries amended after departure or for circumstances arising beyond the control of tour operator but the operator shall make necessary efforts to meet with the travel schedule.
iii. The client may wish to cancel travel arrangement at any time by written notice to the tour operator’s offices and pay cancellation charges of 85% of the quoted price if client cancels less than 45 days prior to departure, and 100% of the same if less than 21days, unless other arrangements are made.
iv. The client shall not be refunded if he/she does not appear for any accommodation, meal, service, sightseeing activity, trip segment, or leave programme after it has begun provided that prior approval have been made.
F: FORCE MAJEURE
i. “Force Majeure ” means, in relation to the company, any circumstances beyond the control of the company (including and without limitation, acts of God, explosions, floods, tempests, fires, accidents, war or threat of war, sabotage, insurrection, civil disturbance or requisition, sickness, quarantine, government intervention, weather conditions or other outwards occurrences)
ii. If the company is affected by force majeure it shall forthwith notify you of the nature and extent thereof. The company shall not be deemed to be in breach of these items and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any force majeure.
Iii. If the company is affected by force majeure it shall be entitled to, and may at its sole and absolute discretion, vary or cancel any reservations or cancel any reservation or arrangement in relation to the visits. Payment of any refund by the company to you as a result of the non-performance of any company shall use its reasonable endeavors to reimburse you where possible. However, the company shall be entitled to deduct from any refund recoverable to the reasonable actual and potential costs to the company of the force majeure.
G: PRICE CHANGES
All our prices are based on the current national park fees and taxes. There have been ongoing talks that East African countries will be undergoing changes to tax regulations in 2014. Should the authorities decide on increasing fees and taxes, even though they might currently not be scheduled, we would subsequently have to pass on these increases to you.
H. BAGGAGE
At any time, all baggage and personal effects are at the client’s responsibility and the Company does not accept any liability for any loss or damage of any personal effects, howsoever arising. * Clients are entitled to one bag of not more than 15 kg (backpack or soft bag – no hardtop suitcase) and a daypack. The Company reserves the right to refuse excess baggage. Please notice that on our trekking tours and on some “bush” flights other baggage regulations may apply.
